Acceptance of Terms
By accessing or using Trail Draw ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. These terms apply to all users of the Platform, including event organizers, participants, and visitors.
Description of Service
Trail Draw provides a digital platform for organizing and participating in poker run events. The Platform enables event organizers to create events, define routes and checkpoints, manage registrations, and track scoring. Participants use the Platform to register for events, check in at checkpoints, and view their hand rankings and leaderboards.
Account Registration
To access certain features, you must create an account using your email address. You are responsible for maintaining the confidentiality of your authentication credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as necessary.
Organizer Responsibilities
As an event organizer, you are solely responsible for: (1) obtaining all necessary permits, licenses, and insurance for your events; (2) ensuring your events comply with all applicable local, state, and federal laws, including charitable gaming and gambling regulations; (3) handling all participant payments, refunds, and prize distribution directly — Trail Draw does not custody or process participant entry fees for self-service organizers; (4) collecting and maintaining liability waivers from all participants; (5) the safety and conduct of your events. Trail Draw provides a technology platform only and does not organize, sponsor, or endorse any individual event.
Payments and Fees
Organizers may purchase event credits through Stripe, our payment processor. By making a purchase, you agree to Stripe's terms of service and privacy policy. Trail Draw does not store your full payment card details. All sales are final except as required by applicable law. For self-service organizers, participant entry fees are handled directly by the organizer — Trail Draw does not process, custody, or intermediate these payments.
Prohibited Conduct
You agree not to: (1) use the Platform for any illegal purpose or in violation of any applicable laws; (2) interfere with or disrupt the Platform or servers; (3) attempt to gain unauthorized access to any part of the Platform; (4) use the Platform to transmit malware, spam, or other harmful content; (5) impersonate any person or entity; (6) reverse engineer, decompile, or disassemble any part of the Platform; (7) use the Platform for any gambling activity prohibited by law.
Intellectual Property
The Platform, including its code, design, logos, trademarks, and content (excluding user-generated content), is owned by Trail Draw and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our prior written consent. You retain ownership of content you create and upload to the Platform, but you grant Trail Draw a license to use, store, and display it as necessary to provide the service.
Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. Trail Draw does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Trail Draw makes no warranties regarding the accuracy, reliability, or completeness of any data, results, or content provided through the Platform.
Limitation of Liability
To the maximum extent permitted by applicable law, Trail Draw shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Platform. In no event shall Trail Draw's total liability exceed the amount you paid to Trail Draw in the twelve months preceding the event giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless Trail Draw and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of: (1) your use of the Platform; (2) your violation of these Terms; (3) your violation of any rights of a third party; or (4) any event you organize or participate in using the Platform.
Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via email (to the address associated with your account) or through a notice on the Platform. Your continued use of the Platform after changes become effective constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Michigan.
